Deafness

Noise induced hearing loss, occupational deafness, industrial deafness: all of these terms refer to the hearing being damaged as a result of the work environment. It covers the sudden loss of hearing as a result of an accident as well as the (more common) deterioration of hearing levels slowly over time due to exposure to damaging levels of sound without adequate protection.

Deafness or damage to hearing suffered in the workplace normally happens in environments such as factories, mines or ship-builders: places where loud machinery is a part of every-day work. Of course, most companies adhere to the strict health and safety guidelines (as set out in the Noise At Work Act of 1989) which protect the workers' hearing. However, in the cases where employers have proved negligent in their duty of care to their employees by failing to provide the necessary protection, those employees can make a compensation claim for their deafness or loss of hearing as an industrial disease or personal injury.
